1. Agreement to Terms

By accessing or using the AIM Data Cleansing service at aimdatacleansing.com (the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and AIM Data Cleansing ("we," "us," or "our").

2. Description of Service

AIM Data Cleansing provides an automated data cleansing and validation service that:

• Accepts spreadsheet files (Excel, CSV) for processing
• Validates, cleans, and standardizes data
• Generates detailed validation reports
• Returns processed files in a secure, password-protected format

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

3. Account Registration and Security

3.1 Account Requirements

To use the Service, you must:

• Be at least 18 years of age
• Provide accurate and complete registration information
• Maintain the accuracy of your account information
• Have the legal authority to enter into this agreement

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your password
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Using a strong, unique password

Security Note: Your passwords are encrypted and never visible to AIM Data Cleansing personnel. We cannot recover lost passwords, only reset them.

3.3 Account Termination

We reserve the right to suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent or illegal activities
• Abuse or misuse the Service
• Fail to pay applicable fees

4. Subscription Plans and Payments

4.1 Subscription Tiers

We offer multiple subscription tiers:

• Free Trial: 1 credit for evaluation purposes
• Starter: Monthly subscription with 10 credits
• Business: Monthly subscription with 50 credits
• Scale: Monthly subscription with 200 credits
• Enterprise: Custom pricing for unlimited usage

4.2 Credits System

• Each job processing consumes 1 credit
• Credits are non-transferable and non-refundable
• Unused credits expire at the end of your billing cycle
• Credits reset monthly on your subscription renewal date

4.3 Payment Terms

• All fees are in GBP (£) unless otherwise stated
• Payments are processed securely through Stripe
• Subscriptions auto-renew monthly unless cancelled
• You must provide valid payment information
• Failed payments may result in service suspension

4.4 Billing and Invoices

• You will be billed on your subscription start date each month
• Invoices are sent to your registered email address
• Prices are subject to change with 30 days notice
• VAT or other taxes may apply based on your location

4.5 Refund Policy

• Subscription fees are generally non-refundable
• Refunds may be issued at our sole discretion for service failures
• Request refunds within 7 days of the charge
• Unused credits are not refundable upon cancellation

4.6 Cancellation

• You may cancel your subscription at any time from your Profile
• Cancellation is effective at the end of your current billing period
• You retain access until the subscription expires
• No refunds for partial months

5. Acceptable Use Policy

5.1 Permitted Use

You may use the Service only for:

• Legitimate data cleansing and validation purposes
• Processing your own data or data you have authorization to process
• Business operations in compliance with applicable laws

5.2 Prohibited Activities

You may NOT:

• Upload files containing illegal, harmful, or sensitive personal data without authorization
• Process data in violation of GDPR, data protection laws, or privacy regulations
• Upload malware, viruses, or malicious code
• Attempt to reverse engineer, hack, or compromise the Service
• Share your account credentials with others
• Use the Service for automated, bulk, or excessive processing beyond fair use
• Resell or redistribute the Service without authorization
• Interfere with other users' access to the Service
• Violate any applicable laws or regulations

6. Data Processing and Ownership

6.1 Your Data Ownership

You retain all rights, title, and interest in your data files. By uploading files, you grant us a limited license to process, store, and deliver cleaned data back to you.

6.2 Data Confidentiality

We commit to:

• Treat your data as confidential
• Not access, view, or use your data except as necessary to provide the Service
• Not share your data with third parties except as required by law
• Implement appropriate security measures to protect your data

6.3 Data Retention

• Active jobs: Until you delete them
• Archived jobs: 90 days, then permanently deleted
• Deleted jobs: Permanently removed within 30 days
• You can request immediate deletion by contacting support

6.4 Backup and Recovery

• We maintain backups for disaster recovery purposes
• Backups are retained for 30 days
• We are not responsible for data loss due to user error
• Download your processed files promptly

7. Service Availability and Performance

7.1 Uptime Commitment

We strive to provide 99.5% uptime for the Service, excluding scheduled maintenance. However, we do not guarantee uninterrupted availability.

7.2 Scheduled Maintenance

• We may perform scheduled maintenance with advance notice
• Emergency maintenance may occur without notice
• Service interruptions do not entitle you to refunds or credits

7.3 Service Limitations

• Maximum file size: 1GB per upload
• Processing time: Varies by file size - typically 2-60 minutes
• Supported formats: Excel (.xlsx, .xls, .xlsm), CSV, TXT, DAT
• Fair use policy applies to prevent abuse

8. Intellectual Property Rights

8.1 Our Intellectual Property

The Service, including all software, algorithms, design, content, and trademarks, is owned by AIM Data Cleansing and protected by copyright and intellectual property laws.

8.2 License to Use

We grant you a limited, non-exclusive, non-transferable license to access and use the Service in accordance with these Terms.

8.3 Restrictions

You may not:

• Copy, modify, or create derivative works of the Service
• Reverse engineer or decompile any part of the Service
• Remove or alter any proprietary notices
• Use our trademarks without written permission

9. Disclaimers and Limitations of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9.2 No Guarantee of Accuracy

While we strive for accuracy, we do not guarantee that the data cleansing results will be error-free or meet your specific requirements. You are responsible for verifying the accuracy of processed data.

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AIM DATA CLEANSING SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Service interruptions or data loss
• Errors or inaccuracies in processed data
• Unauthorized access to your account or data

Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

9.4 Your Responsibility

• Verify the accuracy of processed data before use
• Maintain backups of your original data
• Comply with data protection and privacy laws
• Use the Service at your own risk

10. Indemnification

You agree to indemnify, defend, and hold harmless AIM Data Cleansing, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising from:

• Your use or misuse of the Service
• Violation of these Terms
• Infringement of third-party rights
• Violation of applicable laws or regulations
• Your data or files uploaded to the Service

11. Dispute Resolution

11.1 Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

11.2 Jurisdiction

Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

11.3 Informal Resolution

Before filing a claim, you agree to contact us at support@aimdatacleansing.com to attempt to resolve the dispute informally.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to this page with an updated "Last Updated" date. Material changes will be communicated via:

• Email notification to your registered email address
• Prominent notice on the Service
• In-app notification

Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms. If you do not agree, you must discontinue use of the Service.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AIM Data Cleansing regarding the Service and supersede all prior agreements and understandings.
